I don't know how it works for NY, but for Michigan, the car has to be in the shop 4 times for the same thing within 6 months, or spend something like more than half the days in a month in the shop in a single month. If you have any questions on how Toyota is going to respond to a claim for lemon law, I can tell you everything you want to know since I already went through it with them.

It's obviously going to depend on your situation, but here was mine. I bought the car the first week it hit the lots. Within the first 6 months, the car was in the shop 11 times. 5 times for the pulling to the left, 1 for the window seal on the drivers side going fubar, 3 for the tire pressure light not working, 1 for the CD player giving me nonstop error displays, and 1 for the moonroof grinding like there was no tomorrow. On top of that, I own aftermarket Satellite radio. One of the times I dropped it off (the CD Player time) they broke my satellite radio receiver. When I asked them about it they said it was an aftermarket thing I had done, and it wasn't their responsibility to fix/replace it, so 100$ later, I got sick of batteling with them on it and replaced it myself. The order of procedure is for you to go through arbitration. You'll send a VERY detailed letter describing your problems, and this arbitrator will say yes, you have a valid claim or no you don't. Even with everything I had problems with, they said I didn't have a valid claim, so you can imagine how many of these actually get put through to Toyota as a "problem" car. Well when I got denied, I went to lemonauto.com (They don't have offices in NY sorry). My attorney had me send over everything that I had. I highly recommend that you have records of everything. I had all the sheets from doing my oil, every service sheet etc. They took all that, and went after Toyota. Toyota told them to eat a big one, they weren't going to replace my car if the Arbitrator didn't see fit that it needed to be replaced. We filed in state court. Toyota WILL harrass you. They will have people call you and pester you, and there's nothing you can do about it other than tell your lawyers. Be sure you find a different shop to start taking your car to as your lawyer will tell you this anyway. If you think Toyota's service is bad now, just wait till they get wind that you're suing them. It gets worse. In the end, my Lawyers told me that I could battle this down to have them take the car back (which he said would probably take a year to 2 years depending on how bad Toyota wanted to stall things), or I could just ask for a reasonable amount of money and Toyota probably would pay that. I asked for 15K and got 10. Lawyers fees were contingent, so they got 1/3. If you have any other questions, let me know.

i have exact same problems with the car that you have just mentioned above...except they damaged my car 3 times out of 12 times it was in the shop..the thing is that my car is leased how does it work then

You definitely need to talk to a lawyer, most lemon auto attorneys will give you free counsel on what to do, but from what I know of the warranty, ALL issues with warranty service needs to be taken through the steps I had to go through.

what are the steps with the warranty that you must go through? Is there any way possible to get rid of a leased car earlier.

If anything, I would think it would be easier to drop a leased car than a purchased car. As for the steps, it's all laid out in the warranty handbook in your glovebox. First step is contact the dealership management, then arbitrator, then lawyer. [/list]

Need more info on the lemon law? Let me know. I have SUCCESSFULLY done it on a 2000 Pontiac Grand Am, a 2001 Pontiac Grand Prix, a 2003 Toyota Celica GTS, and also a 2003 Toyota Solara- All 4 times, I won and the car was bought back. Let me know if you need any more info.

I was fished in because I've seen freaky intermittant probs like that before, but it did stink a little to me. Props to you guys for putting it all together. 8) Can we stop listening to his Solara-hatin' now? He's been whining for over a year and he's just trying to get a free-ride (no pun intended)

That story does sound pretty fishy now - especially after hearing about all the other Lemon Law Buy-backs the guy has bragged about.

Makes you wonder what the real story is here... :-?
