It's obviously going to depend on your situation, but here was mine. I bought the car the first week it hit the lots. Within the first 6 months, the car was in the shop 11 times. 5 times for the pulling to the left, 1 for the window seal on the drivers side going fubar, 3 for the tire pressure light not working, 1 for the CD player giving me nonstop error displays, and 1 for the moonroof grinding like there was no tomorrow. On top of that, I own aftermarket Satellite radio. One of the times I dropped it off (the CD Player time) they broke my satellite radio receiver. When I asked them about it they said it was an aftermarket thing I had done, and it wasn't their responsibility to fix/replace it, so 100$ later, I got sick of batteling with them on it and replaced it myself. The order of procedure is for you to go through arbitration. You'll send a VERY detailed letter describing your problems, and this arbitrator will say yes, you have a valid claim or no you don't. Even with everything I had problems with, they said I didn't have a valid claim, so you can imagine how many of these actually get put through to Toyota as a "problem" car. Well when I got denied, I went to lemonauto.com (They don't have offices in NY sorry). My attorney had me send over everything that I had. I highly recommend that you have records of everything. I had all the sheets from doing my oil, every service sheet etc. They took all that, and went after Toyota. Toyota told them to eat a big one, they weren't going to replace my car if the Arbitrator didn't see fit that it needed to be replaced. We filed in state court. Toyota WILL harrass you. They will have people call you and pester you, and there's nothing you can do about it other than tell your lawyers. Be sure you find a different shop to start taking your car to as your lawyer will tell you this anyway. If you think Toyota's service is bad now, just wait till they get wind that you're suing them. It gets worse. In the end, my Lawyers told me that I could battle this down to have them take the car back (which he said would probably take a year to 2 years depending on how bad Toyota wanted to stall things), or I could just ask for a reasonable amount of money and Toyota probably would pay that. I asked for 15K and got 10. Lawyers fees were contingent, so they got 1/3. If you have any other questions, let me know.
