before you speak again with the adjuster, do some homework. Search every place you can (local car lots, local newspapers, auto trader, online websites for used cars in your local area, etc.) and compile a long list of cars as close as possible to your own ( similar mileage, model and trim level, year, etc.). Don't just write them down, cut out the ad or print it off, if possible. Obviously, try to pick out the highest priced ones that are similar to yours. Faced with that kind of research, it will be much more difficult for the adjuster to offer you some lower value he has pulled out of a book. In other words, show him what your car is worth in your local market.
While the insurance company has the option to repair or replace, they must be able to justify the cash value they are giving you if they choose replacement. Your efforts will help get you a fairer price than relying on them to give you a fair price.
If they object to a higher requested price from you and attempt to coerce you into taking a lower settlement or threaten they will then repair the car, you say that will be fine. Then you have the right to pick the body shop. You pick the absolute most expensive body shop in town that does work on Ferrari's, etc. As the accident was entirely not your fault, you have the right to insist that the repair must be perfect and you won't accept substandard work at an inferior bodyshop. When the adjuster sees the cost of doing the work at the high end bodyshop, the higher writeoff value amount you're looking for won't seem so bad. And, the insurance company still gets to keep the salvage value for themselves.
The job of the adjuster is to get the best settlement he can for his insurance company which is responsible for your loss. He is not working for you. Only your own efforts and refusal to be bullied by him into accepting less for your loss will result in you getting the kind of treatment you're looking for. On the other hand, arbitrarily high values out of a book will not help you either because they are going to be using different books and ultimately, they will look in the local papers too, to justify their price.

man, sorry about the loss. that is some serious damage. I think a G35 coupe is the way to go though. just my two cents. :wink:

749009, That info is GOLD! Thanks! I'm going to do that. However, the insurance agent said he was hiring a "third party" to do the price investigating. Wouldn't that eliminate any bias?

Nonetheless i'll still do my own investigating.

The infinity G35 probably shouldn't even be on my list. Can't afford that unless I get one a few years old. Actually, most of those cars I would plan on getting used.

I'd say look what for you solara didn't have and you wished it did, then compile your list. If it were to happen to me, i'd choose another solara or a gen 4 camry!

I say just trash the car, and take the big fat check that you should get from her insurance company.
Just get another Solara wit more option you wanted from teh old Solara, and get in your new car.

The fact that the insurance company is looking to an independant 3rd party to establish fair market value for your car gives the appearance that bias is being eliminated, but, the proof of that will be in the write off value that they offer you. That is why it's critical for you to do your own research so that you know what your car is worth before they make you their offer.
After all, they are the ones who are hiring this 3rd party and if this person constantly gave them high writeoff values, I'm certain they would not continue to use his services.
Many insurance companies simply look to a wholesale value book to give them a number to offer clients who have had their cars written off.
The only way you can effectively fight them is to show them that their number is wrong and that yours is right because you can show them numerous for sale ads for cars just like yours.
Obviously if your research indicates that your car is worth less than they offer you, smile and accept their offer and cheque. However, that situation is rare. If the insurance company suggest that because the number they offer you was generated by an independant 3rd party, it must be a correct number, you'll have to disagree and advise them that his independance doesn't guarantee he is going to do his job properly. If his number is significantly less than your research, ask them how they can justify offering you much less than the ads you are showing them.

holy crapolas!!! sorry man, but that baby is definitely totaled . . . your frame definitely looks bent & tweaked hardcore, thus=totalled. it wouldn't be safe or worth it to fix all that, even if the lady pays for it all. sorry man.

damn thats crazy. old people shouldnt be able to drive.

but most likely your insurance company would give you the kbb price. when my accord was stolen , my insurance company gave me the kbb price. I had allstate insurance. It took about 2 months before I got my fat check.

looks like the car that hit you was blue and probably had some major damage as well, i noticed the coolant puddle on the ground. i hope her car was totaled too.

WOW , didnt think a ford probe can do such damage at 35 mph. Absolutely totaled, and i say you will only get around 12000.

Her insurance company is cutting me a check for $17,000! That includes taxes and title transfer fees. 749009, that is good advice but i don't think i'm gonna put up much of a fight over this offer.

I did a little checking around and this is pretty consistant with what fully loaded SLEs are going for here in michigan.

Talk about keeping their value well...
